INSURANCE BROKERAGE FOR REGIONAL & MUTUAL INSURERS

Your Own Insurance Should Reflect the Underwriting and Claims Work You Do

Send one issued policy ahead, your D&O or your E&O, declarations and endorsements included. In one free hour, we examine that policy's wording and discuss the other points of our annual 8-Point Stress Test from what you tell us about your program. You keep the findings and a fix list for the policy you send, whether or not you appoint LION.

  • Strengths in the policy you send
  • Any wording gaps identified in that policy
  • A fix list for that policy, which you keep

BEFORE A CLAIM TESTS YOUR COVERAGE

Your own policy can leave underwriting and claims responsibilities unclear

  • Does your professional-services wording describe the underwriting and claims work you perform?
  • Can you explain the limits and retentions you recommend to your board?
  • Have you examined how corporate coverage and reinsurance obligations fit together?

A familiar policy can leave important activities or obligations open to interpretation, and late renewal terms leave less time to resolve them. We compare the policy you send with the activities you describe.

THE 8-POINT STRESS TEST

The 8-Point Stress Test, point 03 Coverage efficacy highlighted: your assessment starts here

Eight questions, every client program, every year. The policy you send is read at the highlighted point; the rest are discussed from what you tell us.

PROFESSIONAL LIABILITY

Check that your policy describes the insurance work you perform

If you send your E&O policy, we examine these provisions where they appear. Underwriting and claims handling have to be read against your professional-services definition; the policy's name alone does not answer that question. We connect the activities you describe, and the allegations that reach carriers like yours, to the provisions that would respond, and mark the wording that needs negotiating.

  • Professional-services definition against underwriting and claims handling
  • ECO/XPL provisions in the submitted policy, and the questions to take back to your reinsurance review
  • Claims-handling and bad-faith allegations against exclusions and carve-backs

EXECUTIVE DECISIONS

Explain the protection behind your board's own D&O

If you send your D&O policy, we examine these provisions where they appear. A regulated risk-bearing entity and its directors can have different interests the day a claim develops. A state examination, a reserving dispute after an acquisition, a shareholder or policyholder action are the kinds of events we discuss. We read Side A, severability, allocation, and the claim definition for the moment the institution's interests and yours diverge.

  • Side A wording, and whether its limit is shared or dedicated
  • How conduct exclusions apply to different insureds, including severability and adjudication wording
  • Whether the claim definition includes the examination or proceeding you are concerned about, and which response costs it addresses

ANONYMIZED PLACEMENT EXAMPLE

A closer review changed the renewal

A mutual insurer let its most trusted producer handle its own corporate D&O and E&O. The relationship felt efficient. The review found more than a dozen material gaps across fraud exclusions, allocation language, and notice provisions. The institution moved its full program on the strength of that review. This example involved a broader engagement; your free assessment covers the policy you send.

More than a dozen

material gaps found in the review

The lesson for your institution: read the wording and the structure together, even when the existing relationship feels comfortable.

ONE POLICY, ONE HOUR

What to send

Send one issued D&O or E&O policy, declarations and endorsements included. If both coverages are written in one issued policy, send that complete policy. That is the whole preparation.

Within the 8-Point Stress Test, the policy is read through five questions. The remaining points are discussed from what you tell us about the program.

  • Who is insured?Which people, entities, and activities the wording includes.
  • When does coverage attach? The trigger, reporting requirements, and timing provisions.
  • Who controls the defense?Counsel selection, consent, settlement authority, and conditions.
  • What does the form take away?Exclusions, restrictions, and any exceptions that give coverage back.
  • How much is actually available?Limits, sublimits, retentions, and what erodes them.
